Mail requests are accepted. Send your written request to P.O. Box 7, Rustburg, VA 24588 with both party names, the case year, your contact details, and a self-addressed stamped envelope. Include payment for any copy fees. The office will mail back what you need.
Under § 32.1-271, records less than 25 years old are restricted to the named parties, immediate family members, and their attorneys. Once 25 years have passed, the records are public. The first certified copy of a final decree is free for the parties under § 17.1-275. Additional pages cost $0.50 each.
Divorce Certificates Through VDH
The Virginia Department of Health maintains divorce certificates from 1918 forward. These are brief documents showing the parties' names, the date, and the county. They do not include case details, property terms, or custody orders.
A VDH certificate costs $12. Contact the Office of Vital Records at 8701 Park Central Drive, Suite 100, Richmond, VA 23227 or call 804-662-6200. These records are subject to the same 25-year access rule that applies to court records under § 32.1-268.
The certificate is useful for updating government IDs or confirming a divorce. The court decree is what you need for property matters, name changes, or legal proceedings. Both are official. Which one you need depends on your purpose.

Virginia has two types of divorce under § 20-91. No-fault requires one year of separation. That drops to six months if both parties sign a property settlement and there are no minor children. Fault grounds include adultery, a felony with prison time, cruelty, and desertion.
When property is contested, the court divides assets under § 20-107.3. Virginia uses equitable distribution, meaning the court decides a fair split. The final decree covers all issues, including custody and support when children are involved.
