Virginia Divorce Law and Filing
To file in Fluvanna County, you or your spouse must have resided in Virginia for at least six months. Cases go to the Circuit Court in Palmyra. Under § 20-91, Virginia recognizes no-fault and fault-based divorce.
No-fault divorce is by far the more common approach in Fluvanna County. You need to live separately from your spouse for one year. If you both sign a separation agreement and have no minor children together, six months of separation is sufficient. Fault grounds include adultery, felony conviction and imprisonment, cruelty, and desertion. Evidence is required to support a fault-based claim.
Under § 20-107.3, the court divides marital property and debts through equitable distribution. The goal is a fair outcome, not necessarily an equal one. Factors include contributions of each spouse, the length of the marriage, and each party's financial status. Separate property is not divided.
